Custom & Project Artwork Terms

1. Scope of These Terms

These terms apply to custom artwork requests, project inquiries, trade sourcing, hotel and interior art programs, private-label painting requests, and any order where the customer provides reference materials or production instructions.

They work together with our Copyright Notice, Privacy Policy, Shipping Policy, and applicable quotation or invoice terms.

2. Customer-Submitted Materials

By submitting an inquiry or order, you confirm that you are authorized to provide all images, photos, artwork references, sketches, room photos, logos, trademarks, characters, brand materials, written instructions, or other materials included in your request.

• Your materials should be owned by you, licensed to you, in the public domain, or otherwise legally available for the intended custom artwork or project use.
• Do not submit protected artwork, celebrity images, living or contemporary artists' works, branded characters, logos, private photos, or third-party designs unless you have permission or another legal right to use them.
• You confirm that DafenArts may rely on your submitted materials and instructions when reviewing, quoting, painting, correcting, previewing, approving, packing, shipping, and supporting your order.

3. Review, Revision, Refusal, or Cancellation

DafenArts reviews custom and project requests for production fit, but we cannot independently verify the rights status of every image or design in the world. We rely on customer representations unless a request appears obviously high risk.

• We may ask for clarification, request a different reference, suggest an original interpretation, or refuse direct copying when a request appears to involve third-party intellectual property.
• We may decline, pause, revise, cancel, or refund an inquiry or order that appears to involve unauthorized protected artwork, branded content, characters, logos, living artists' works, celebrity likenesses, privacy issues, illegal content, or unclear import risk.
• Acceptance of an inquiry, quote, or payment does not mean DafenArts has verified ownership, licensing, customs eligibility, or commercial-use rights in the submitted materials.

4. Limited Permission to Use Submitted Materials

You grant DafenArts a limited permission to use the materials you submit only as reasonably needed to review, quote, communicate about, produce, revise, preview, approve, document, pack, ship, insure, and support your custom or project artwork.

This limited permission does not transfer ownership of your private photos or project materials to DafenArts. It also does not grant DafenArts public marketing rights in private portraits, family photos, pet photos, room photos, or confidential project references unless you separately agree.

5. Import, Display, Resale, and Commercial Use

You are responsible for confirming that your requested artwork, submitted references, and intended use are lawful in the destination country and in the place where the artwork will be displayed, resold, published, or commercially used.

• Project, hotel, gallery, designer, and trade customers should confirm any required rights for public display, resale, advertising, catalog use, brand campaigns, packaging, merchandise, or online promotion.
• DafenArts does not provide copyright, trademark, publicity-rights, customs, tax, import, or resale legal clearance unless a separate written agreement says so.
• If customs, carriers, payment providers, marketplaces, or rights holders request information about materials you supplied, you agree to cooperate promptly and provide supporting authorization where available.

6. Third-Party Claims and Customer Responsibility

If a third-party claim, takedown request, customs issue, payment dispute, chargeback, legal demand, loss, cost, or expense arises from materials or instructions you provided, you agree to cooperate with DafenArts and to be responsible for the resulting claims, losses, costs, or expenses to the fullest extent permitted by law.

This includes claims involving copyright, trademark, publicity rights, privacy rights, false authorization, prohibited import materials, or commercial-use rights connected to customer-submitted references or instructions.

7. Private References and Confidential Project Materials

We treat private custom references and project materials as order materials. They are shared with the studio, support, shipping, payment, or insurance providers only when reasonably needed to complete or support the order.

• Private portraits, family images, pet photos, room photos, and unpublished project references are not used as public marketing examples without permission.
• If a project requires stricter confidentiality, tell us before sending sensitive materials so we can confirm whether the studio can support that requirement.
